Definitions

  • "Client" refers to any person or entity that commissions or purchases services from MystaGallery.
  • "Content" refers to any material provided, displayed, or generated by MystaGallery, including but not limited to illustrations, designs, text, graphics, images, and video content.
  • "Services" refers to any creative services offered by MystaGallery, including but not limited to custom artworks, visual storytelling, character design, promotional visuals, and concept development.

Services and Orders

Service Provision

MystaGallery provides creative services as outlined on our website. We reserve the right to refuse service to anyone for any reason at any time.

Order Process

By placing an order, you agree to provide accurate and complete information. You must be at least 18 years old or have the legal capacity to enter into a contract. An order is not confirmed until you have received a written confirmation from MystaGallery.

Pricing and Payment

All prices are subject to change without notice. Payment terms will be specified in the order confirmation. Unless otherwise stated, full payment is required before work commences on any project.

Project Timeline

Timelines for project completion will be provided in the order confirmation. MystaGallery is not responsible for delays due to factors beyond our reasonable control.

Revisions and Approvals

Each project includes a specified number of revision rounds as stated in the order confirmation. Additional revisions may incur extra charges. Final approval of deliverables is required from the Client before the project is considered complete.

Intellectual Property Rights

Ownership

Until full payment is received, MystaGallery retains all intellectual property rights to the created work. Upon full payment, the specified rights will be transferred to the Client as outlined in the order confirmation.

License

Unless explicitly stated otherwise in writing, MystaGallery grants the Client a non-exclusive license to use the deliverables for the agreed purposes. Any additional usage rights must be negotiated separately.

Portfolio Rights

MystaGallery reserves the right to display and use all completed work in our portfolio, social media, and other promotional materials unless otherwise specified in a written agreement.

Confidentiality

MystaGallery agrees to maintain the confidentiality of any proprietary information provided by the Client during the course of the project. The Client agrees not to disclose any confidential information about MystaGallery's processes or business operations.

Website Usage

Acceptable Use

You agree to use our website only for lawful purposes and in a way that does not infringe upon the rights of others. You are prohibited from using our website in any way that could damage, disable, overburden, or impair the website or interfere with any other party's use of the website.

User Content

If you submit content to our website (such as in comments or contact forms), you grant MystaGallery a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, publicly display, reproduce, and distribute such content.

Termination

Either party may terminate a project if the other party breaches these Terms and fails to remedy the breach within 14 days of written notice. In case of termination:

  • If terminated by the Client, the Client shall pay for all work completed up to the date of termination.
  • If terminated by MystaGallery due to Client's breach, the Client shall pay for all work completed plus 25% of the remaining project fee as compensation for the termination.

Limitation of Liability

MystaGallery shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services or website. Our total liability for all claims related to these Terms shall not exceed the amount paid by you for the services in question.

Indemnification

You agree to indemnify, defend, and hold harmless MystaGallery and our affiliates, officers, directors, employees, agents, and licensors from and against all losses, expenses, damages, and costs resulting from any violation of these Terms by you or any activity related to your account.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MystaGallery is registered, without regard to its conflict of law provisions.

Changes to Terms

MystaGallery reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services following the posting of revised Terms means that you accept and agree to the changes.
